The terms of use of the site and of sale of Tunnaliva products.
Last updated: 28 September 2026
These terms govern the distance selling of the products offered on this site and the use of the site itself. Making a purchase entails full acceptance of these terms.
The products are described on their respective product pages. The images are indicative. Availability is kept up to date but is not guaranteed in real time: should a product become unavailable, you will be informed and may obtain a refund of any sum paid.
Prices are expressed in Euro and are inclusive of VAT. Delivery costs, where applicable, are indicated before the order is completed. We reserve the right to change prices at any time; the price applied is the one displayed at the time of the order.
The contract is concluded when you receive the order confirmation by email. Before submitting the order you can check and correct the details you have entered.
Online payments are processed through Stripe and PayPal, according to the method available and selected at checkout. Card details do not pass through our systems and are not stored by us. Preparation follows the chosen method: after funds arrive for bank transfers, after confirmation for cash on delivery. The methods accepted at any given time are those listed on the Payments page and shown at checkout.
Available destinations, costs and delivery times are shown on the Shipping page and at checkout. Unless a different deadline is agreed, delivery takes place within 30 days of the contract. Statutory rights in case of delay, including termination where applicable, remain unaffected. Risk of loss or damage passes when you take physical possession, except when you independently appoint a carrier we did not offer.
If you are buying as a consumer, you have the right to withdraw within 14 days of delivery, without giving any reason, under Articles 52 et seq. of the Italian Consumer Code (D.lgs. 206/2005).
Being food does not automatically exclude withdrawal. Exceptions concern goods liable to deteriorate or expire rapidly and sealed goods unsuitable for return for hygiene or health reasons that have been unsealed after delivery. Rights concerning defects and non-conformity remain unaffected.
To exercise the right of withdrawal it is enough to tell us within the time limit, by writing to info@tunnaliva.com. No particular form is needed: any explicit statement will do. If you prefer to use one, the model form provided for by Annex I, Part B of the Italian Consumer Code is the following — copy it into the email and fill in the parts in brackets:
You can also withdraw from the contract here: we will send a receipt containing your notice and its submission date and time.
I hereby give notice of my withdrawal from the contract of sale of the following goods: [list of products]. Ordered on [order date] and received on [delivery date]. Name of the consumer: [first name and surname]. Address of the consumer: [address]. Date: [date].
We refund payments received, including standard delivery costs when withdrawing from the whole order, without undue delay and within 14 days of your withdrawal notice. We do not refund the surcharge for a more expensive delivery option you selected. We may withhold the refund until we receive the goods or evidence of return, whichever comes first, unless we offered to collect them. Refunds use the same payment method at no extra cost. See Returns for instructions.
Consumers benefit from the legal guarantee of conformity (24 months) provided for by the Italian Consumer Code. If a product is defective, damaged in transit or not in conformity, contact us promptly: we will arrange a replacement or a refund.
For any complaint, write to info@tunnaliva.com: we reply within a few working days and always seek a direct solution.
If no agreement is reached, the consumer may turn to an alternative dispute resolution (ADR) body among those entered in the official Italian lists, or — for a cross-border purchase within the European Union — to the Centro Europeo Consumatori Italia. The right to bring proceedings before the competent court remains unaffected in any event.
The European ODR platform can no longer be used: it ceased operating in July 2025 and the regulation establishing it has been repealed. The previous terms still indicated it as a remedy.
Choosing Italian law does not deprive consumers of mandatory protections in their country of residence where applicable. Mandatory consumer jurisdiction rules apply, including Article 66-bis of the Italian Consumer Code where relevant. For business purchases, the courts at the seller’s registered office have jurisdiction.
Tunnaliva is not liable for non-performance due to force majeure or unforeseeable events beyond its reasonable control.
